1. Purpose and Scope of Application
These Terms and Conditions regulate the use of the website and the Property Management and vacation rental management services offered by Fernando Jiménez Lezcano / Vellum Costa on the Costa del Sol. Contracting any service implies the express acceptance of these conditions.
2. Services Offered
The Company offers comprehensive property management services that include, but are not limited to:
- Preventive and corrective property maintenance.
- Reservation management and profile optimization on platforms such as Airbnb, Booking, Vrbo, etc.
- Check-in, Check-out service, and 24/7 guest support.
- Coordination of cleaning, laundry, and landscaping services.
The specific conditions of each service (commission percentages, fixed monthly fees, etc.) will be detailed in an individualized Service Provision Contract signed by the owner.
3. Owner's Obligations
The client (owner) agrees to:
- Guarantee that they are the legitimate owner of the property or have legal authorization for its exploitation.
- Provide sufficient copies of keys and unrestricted access to the Company and its authorized personnel.
- Maintain the property with the corresponding home and civil liability insurance policies in force.
- Report any hidden defects or technical problems with the property prior to the start of the management.
4. Rates, Commissions, and Payments
The rates applicable to vacation rental management are generally calculated as a percentage of the net income from reservations, as stipulated in the private contract with the owner. Maintenance services or fixed fees will be billed monthly. The Company will provide detailed and transparent reports of the income and expenses generated.
5. Liability
The Company will always act with the utmost professional diligence in caring for the property and screening guests. However, the Company is not responsible for:
- Damages caused by guests that exceed the deposits or insurance coverage of the platforms (e.g., Airbnb's AirCover).
- Loss of income derived from force majeure, pandemics, government regulations, or unforeseeable fluctuations in the tourism market.
- Breakages or natural wear and tear of appliances, furniture, or facilities due to the continued use of the property.
6. Termination and Cancellation
Either party may terminate the management agreement by notifying in writing with the advance notice stipulated in the private contract (generally 30 or 60 days). In the event of termination, the Company agrees to manage the reservations already confirmed during that notice period, or to facilitate the transition to a new manager.
7. Applicable Law and Jurisdiction
These Terms and Conditions are governed by Spanish law. For the resolution of all disputes or questions related to this website or the activities carried out on it, the parties submit to the Courts and Tribunals of Málaga, expressly waiving any other jurisdiction that may apply to them.
